Another liability we found in food is that lights that were hanging from the ceiling were very dusty; and this is not good for a person who was allergies. When we wanted to order some food, we noticed that the menus discussed what some of the dishes consisted of; but not in detail for someone who has food allergies. The menus didn’t explain which sides come with the main course also. We also had the opportunity to observe the wait staff while we were waiting for our food and we found some important liabilities which need to be mention. The appearance of the wait staff was very clean but there wasn’t an area for them to wash their hands. We also noticed that many wait staff were doing other things such as cleaning silverware with a spray solution; and then going straight to handling people’s food. Then, when we ordered some hot tea, the wait staff is responsible to explain the customer that tea is hot, even is self explanatory; and also need to put tea pot in the middle of the table and not on the side, just in case it gets knocked over. 1.6 Liabilities-Kitchen When we inspected the kitchen we realized there were many liabilities that needed immediate solution. For example, the heating devices were not maintained in good working order. We could see the heating devices were all dirty and without frequent maintenance. As we all know fire presents various serious risks for the property and the customers and we realized that “El Guayacan”didn’t have any fire safety equipment, as well as fire alarms in the kitchen or other places of the Restaurant. Inside the kitchen there was also trash besides the kitchen devices and this could lead to diseases. Also, the chefs were not using gloves which are essential when handling food or cooking. 1.7 Main liabilities and its solutions As soon as we arrived we noticed that the parking lot was in bad condition; and if obstructions such as trash, woodchips and other objects are found in the parking lot they should be removed immediately. We noticed there were no visible fire alarms and the fire exit was blocked. One solution to this problem would be to check state and local fire-safety laws and strictly comply. The floor was also very slippery and dirty; and one solution for this problem would be the frequent inspection of the floor for dangerous conditions, including excessive polish and spilled food or beverages. Inside the dining room we found hanging mirrors and decorations, this means the restaurant should be vigilant to ensure such mirrors and decorations remain securely attached. In the bathroom, the ceiling and the a/c vent looked like if they were to collapse, is a top priority. The restaurant needs to take immediate action in fixing these problems because this is a lawsuit waiting to happen. Another important liability is the fact that the restaurant isn’t wheelchair accessible. This problem needs to be fixed because this restaurant is discriminating against the handicap people. Leaving condiments on the tables without any lids is a liability because of cross contamination and the chance of bugs flying into these condiments. Bugs could easily get in because they had a door opened which did not have an air curtain. The other problem with not having lids is people sneezing, coughing or accidentally dropping something into these condiments that another customer might me allergic to. 1.2 Introduction We decided to eat in a Restaurant in downtown Miami so we could try the food for Nicaragua and also verify the liabilities of the place. The manager of the Restaurant was very kind to us and as soon as we finished our food he introduced us to the place with a little bit of its history. First he began telling us about the people that first owned the restaurant who emigrated from Nicaragua to United States because of the War in Nicaragua in 1979. Esperanza Estrada began to work at a Restaurant called “El Paisa” as soon as she arrived to United States, which is located in Flagler and 26St. Later the rest of her relatives arrived and during the 80s they decided to open their own Restaurant. In 1987 they rented a store and opened their Restaurant called “Guayacan.” The name of the Restaurant comes from a Restaurant they used to frequent in Nicaragua. Since 1987 until today this Restaurant has bring happiness to Esperanza and her family members. Later, they bought a shopping center that is located in 98 and 40St in S.W. and they opened another Restaurant. 1.3 General Liabilities When we first arrived to the Restaurant we noticed there were some liabilities outside, and then in front of the house and the back of the house. The electrical devices were maintained in bad conditions and there was a wire hanging outside facing the customers. Also, the nails from the wood pedaling were sticking out; and this can be harmful for customers, especially children. The lamps that were hanging from the ceiling were very dirty and we almost fell because of the slippery and dirty floor. We found hanging-plate glass mirrors, pictures and hanging decorations in the dining room which is an unsafe location. There was no security for customers in the parking lot; and it was not properly lighted also. The Restaurant wasn’t wheelchair accessible for handicapped people who need to get in. We also found cracks, garbage and holes in the parking lot, as well as no visible fire alarms. The fire exit was being blocked by tables in the inside and a motorcycle in the outside; this means that this failure is classified as negligence per se. 1.4 Liabilities-Bathroom We saw inside the Restaurant that the bathroom wasn’t wheelchair accessible because was not big enough to have a wheelchair inside. Also, the A/C Vent was not properly installed in ceiling and it could fall someday and hit someone in the head. First, bathroom stall had ceiling collapsing in and it looked as thought it could fall at anytime. Then, the tile was missing from the boarder in restroom which means in easy for rodents or pest to enter which could then go into the kitchen or Restaurant area. People could also have allergies because we found mold on wooden doors underneath the sink. The bathroom stalls did not have adequate toilet tissues which are important in order to maintained good hygiene. We were amazed because we stayed in the Restaurant for 2 hours or more and we did not see anyone going frequently to check washrooms for cleanliness. These are some of the liabilities we found at the Restaurant’s bathroom that need immediate solutions. 1.5 Liabilities-Food While we were eating some food to try Nicaraguan’s food’s taste we realized the serves left the sauces on the tables without lids on them.
