The case involved the Univ. of California, Davis, Medical School, which had two separate admissions pools, one for standard applicants, and another for minority and economically disadvantaged students. The school reserved 16 of its 100 places for this latter group. Allan Bakke, a white applicant, was rejected twice even though there were minority applicants admitted with significantly lower scores than his. Bakke maintained that judging him on the basis of his race was a violation of the Equal Protection Clause of the Fourteenth Amendment. The Supreme Court ruled that while race was a legitimate factor in school admissions, the use of such inflexible quotas as the medical school had set aside was not. The Supreme Court, however, was split 5–4 in its decision on the Bakke case and addressed only a minimal number of the many complex issues that had sprung up about affirmative action. Many people believe that when applying for a job, minorities have a greater chance of getting the job not due to their resume, but to the color of their skin or their background. To many people this does not qualify as equal opportunity or fairness, but discriminates against other candidates for the job. “ The Right has told us to resist affirmative action because it is unmeritocratic, leads to reverse discrimination, and is an un-American guarantee of equal results instead of equal opportunity”(Skrentny 1). The opposing side, the left, has told us to support the program because they feel it is compensation for injustices done to them in the past. They also believe by doing this, minorities will get what they have been discriminated on for decades, which is a fair share on the economic world. There are many different views on the topic, but one significant view is that people shouldn’t be judged on the color of their skin or sex, they should be judged on their performance and experience. By doing this, it gives the position to the best man, and received equal opportunity as well as his fellow candidate.
