... needs in a tougher way. Many homosexuals in society have the need to be accepted in society and to be treated like everyone else. They want to be free from discrimination and be able to live their life without being discriminated against. They do not want to lose job positions or be considered unsuitable for a job because of their status. They would like to have the same rights as a heterosexual couple, have the right to get married and raise children. In order to meet the needs of homosexuals the Australian Government and the NSW Government have introduced legislation. Australian legislation has been amended in order to advantage the gays and lesbians in Australian society. The Federal Family Law Act 1975 has been amended. This includes access to children. The Act provides parenting plans to be agreed between the parties, including contact visits between a child and another person or other persons. These parenting plans include provisions such as with which parent the child shall live with. This is decided on the best interests of the child. The Family Law Act 1975 states that there is a “need to preserve and protect the institution of marriage as the union of a man and a woman to the exclusion of all others voluntarily entered into for life”. However, in a landmark judgement the Family Court found that a marriage that was between a female to male transsexual and his female partner was valid and the definition of “man” should be based on contemporary thinking and not on outdated ideologies. The federal government in the area of discrimination amended legislation to benefit homosexuals. In anti-discrimination law “Homosexual” also incorporates people who are suffering HIV/AIDS. The Disability Discrimination Act 1992 makes it illegal to discriminate against a person because he or she is living with HIV or AIDS, is thought to be living with HIV or AIDS, may have HIV/AIDS in the future, is an associate of someone...
