Determinism & Free Will

Why are some people in prison because they killed or raped or assaulted etc. And my point of view free will does exit in some part of your life and so does determinism. The Argument of moral responsibility states that if determinism were true, no person would be able to change his actions, therefore no one could ever be held morally responsible for his own actions. What if I wanted to steal something thinking no one is watching me and I change my mind because I may think that no one is watching, but someone might be watching so I don’t do it because I don’t want to get caught.
