...hey felt that this was a overstatement because this case is merely a case of equal protection of the law, the Fourteenth Amendment. However, the inferiority of others has nothing to do with equal protection of the law. Therefore the lower federal court has overstated case by referring to inferiority. The lower courts had ruled that school segregation was unconstitutional, but the attorneys’ for the states thought otherwise. They felt that having a segregated school system would be completely unfair to the students being forced to attend the segregated schools. They knew that if they could get the higher court to overturn the lower court decision they would have a chance at winning. Although they had several different reason to try and convince the high courts they had one in particular. Their main argument that they made to the supreme court, was that segregation imposes upon individuals a distorted sense of social reality. They felt that if schools remained segregated, then the students would be in some way socially disabled. To simplify it, the people thought that by segregated schools the students attending the school wouldn’t be able to function in a normal school environment, thus depriving them of their rights under the equal protection clause. In W.E.B Dubois’s 1935 essay, “Does the Negro need separate schools,” he tries to express his understanding and feeling of segregated public schools. He feels that segregated schools are necessary to provide proper schooling for children.. “The proper education of any people includes sympathetic touch between teacher and pupil; knowledge on the part of the teacher, not simply of the individual taught, but of his surroundings and background, and the history of his class and group; such contact between pupils, and between teacher and pupil, on the basis of perfect social equality, as will increase this sympathy and knowledge; facilities for education in equipment and housing, and the promotion of such extra-curricular activities as will tend to induct the child into life.” I believe what he is saying that if we segregate schools then the education for co...
