...ney. (Worker¡¦s compensation Law) Workers¡¦ compensation is ¡§a state program requiring employers to have insurance policies covering employees for accidental work-related injuries¡¨. If employee is injured in the workplace the employer will pay for medical care. Medical cared can be paid also by insurance company. Although the employer pay for insurance and medical needs, the cost of compensation is eventually passed to the ¡§in the form of higher prices for goods and services¡¨. Employees are not charged by any part of the benefits or premium. The available benefits to workers are the following: „X Death benefits „X Temporary and total disability „X Temporary or partial disability „X Medical and related expenses The amount of benefit is determined by the guidelines of the state and is usually up 75% of a worker¡¦s salary at the moment of injury. (2005 Workers' Compensation Act) If an employee dies in the result of job-related injury, the employee¡¦s dependents and spouse are entitled to death benefits up to 70-75% of the employee¡¦s salary. It is noted that workers¡¦ compensation provides also for burial allowance of about $2,500. The compensation is paid for the disability or death of a worker in the result of personal injury in the workplace if the injury isn¡¦t caused by willful misconduct of the employee, by his/hers intention to bring about injury of himself/herself and by intoxication of the injured employee. Compensation is paid in case of disability or death resulting from a war-risk hazard or capture or ¡§other restraint by a hostile force or individual, suffered by an employee who is employed outside the continental United States or in Alaska¡¨. (Worker¡¦s compensation Law) In case if disability of the injured worker is total employee is paid compensation during the disability monthly monetary award that is equal 66% of his monthly salary that is known to be the basic compensation for total employee¡¦s disability. The total disability is considered to be the loss of use of both hands, both feet, both arms, both legs, loss of sight (blindness). When disability is partial employee is paid compensation during his/hers disability monthly monetary award that is equal to 66% of the difference between monthly pay and ¡§monthly wage-earning capacity after the beginning of the partial disability, which is known as his basic compensation for partial disability¡¨. (2005 Workers' Compensation Act) Compensation laws entitle employee to all necessary medical care related to the injury. Medical care includes surgery, visits to health care provider, dental, hospital, podiatric, optometric, chiropractic, nursing care, prescription drugs, psychological services, and other medical supplies ordered by an approved physician.
