CASE ANALYSIS – PAUL CRONAN CASE
LEGAL ANALYSIS MODEL
This case represents AIDS issue of one of the NET Associates-Paul Cronan. ... Additional factual aspect in this case is that the company did don’t have in place any explicit controls in a form of regulations, ethical behavior, policies as tools for action and resolution the issue with both parties mutual agreement, therefore possibly avoiding lawsuit and business damaging exposure. Therefore, the most “critical and relevant facts” in this case are the AIDS illness of one of the NET employees and lack of company’s explicit policy to handle such an issue.
The “key issues” in this case, in my opinion is lack of company’s top management direct involvement from the start of the problem, lack of HR support, lack of proper training and awareness program which should have been provided to all employees. “Is it legal for any company to neglect potential “biohazard” like exposure to AIDS and not providing any training or awareness program to its employees?” Then, if this is the legal question, we may also ask, “What tells any company to cover all aspects of potential disaster happening at workplace? ... Additionally, legal and main question could be “Is it legal for any company to disclose personal and medical employee information without employee’s knowledge and both parties consensus?” Finally, I recognize the last presented question as the most important legal question, where the first two questions could be considered sub-questions that were evolved from main question regarding personal information and medical status disclosure of an associate.
The “legal rules” that apply in this case are laws and principles applied to other companies with similar issue. ... 1 Very similar case and example, of AIDS issue is a 7-year-old girl who was allowed to attend New York school. ... 2 This case also opened eyes of the public and media with the question of how to cope with this disease. ...
Another example of almost the same case scenario could be behavior and actions associated with California men who was diagnosed with the disease and yet had sex with many men not disclosing the information about his health status.
