In John Silber’s essay, “Students Should Not Be Above the Law”, he states even though colleges and universities have the right to protect their students, those students should not receive “sanctuary from the law. ... Defendants who committed a crime during this time preferred a church court because, unlike the king’s court, the churches did not resort to any type of capital punishment during the time when “all felonies were capital crimes”. ... According to Silber, colleges and universities today find a way to avoid restrictions imposed by a rule or law without actually breaking it.
