Background The City-County Council has enacted an ordinance banning the sale, solicitation, and distribution of any goods on any public street or intersection located in the city of Indianapolis or Marion County. The Nation of Islam (NOI) has promised to challenge on the basis that they feel that the ordinance violates their religious and economic constitutional rights. (specifically the right to do business (protected by 5th and 14th Amendments) and their freedom of religion (protected by the 1st Amendment). Further, the NOI likely feels that they are victims of discrimination, as this ordinance will have significant impact on their ability to make money through the sale of their products (bean pies, incense, cologne, and newspapers). They may state that the ordinance discriminates against African-American minorities and/or those of Islamic faith (compared to whites and others), as this is a primary means of raising revenue. The court, in reviewing such a case, will likely apply both intermediate and strict scrutiny in regard to freedom of property and freedom of religion, respectively.
