According to Utilitarianism, as a political morality, a society is rightly ordered or just

when utility is maximized through the ‘basic structure’ of society. That is, when the key

institutions in society are arranged in such a way that they achieve the greatest utility. ... ” This means utilitarianism could possibly have unequal effects on

people yet still claim to be concerned in treating individuals equally. Therefore, an

objection raised to utilitarianism, is its appeal in seeking to treat individuals equally yet

its ability to defy our institutions on the general conception of how to treat individuals

equally. Kymlicka asserts, “Utilitarianism has misrepresented the ideal of equal

consideration,” consequently, allowing some individuals to be treated unequally, “as a

means to other people’s ends.
