The University of California appealed the case to the Supreme Court of California which agreed that the admissions process was unconstitutional. It also decided that Bakke should be admitted because the University did not prove that he would not have been admitted if the special admissions program was not present. The Regents of the University of California appealed the case to the Supreme Court of the United States.
The Defendant in this case was the Regents of the University of California.
