... It was due to that incident that prompted FCC Chairperson Michael Powell to step in and reevaluate its policies, fines, and guidelines, but first questions first: What is the FCC?
“The Federal Communications Commission (FCC) is an independent United States government agency, directly responsible to Congress. ... The FCC was established by the Communications Act of 1934 and is charged with regulating interstate and international communications by radio, television, wire, satellite and cable. ... ” What many people don’t recognize is the extent in which every area of their life is intertwined with the communications technologies the FCC has responsibility to regulate. Almost all electrical and electronic equipment emits radio frequencies, the FCC’s equipment authorization rules protect you when: you use your E-Z Pass, use your microwave, press the button on your garage door opener, every time you swipe your credit card at the gas pump, amongst other things, and the list goes on and on.
“The FCC is directed by five Commissioners appointed by the President and confirmed by the Senate for 5-year terms, except when filling an unexpired term. ... At that time there were only a few frequencies to broadcast on, so in order to prevent ‘Pirate radio’ or someone from broadcasting on another’s frequency or pirating their air space the FCC was formed. As communication technologies advanced so did the FCC’s. ... Congress has given the FCC the responsibility to enforce the law concerning these types of broadcasts. The FCC can revoke a station license, fine the station, withhold or place conditions on the renewal of a broadcast license, or issue a warning, for the broadcast of obscene or indecent material.
