The death penalty is used in the judicial system as a means of punishing a criminal on trial found guilty of a brutal crime. The death penalty is mainly enforced when a murder has been committed. Less than one percent of all murder convictions result in the death penalty and it is only the prosecutors that choose which murderers are to receive that ultimate punishment. The only way a murderer is saved from the death penalty is by pleading guilty to the crime. Two states which practice using the death penalty are Texas and Virginia. Texas has three times the death penalty convictions as Virginia.
