The Fourth Amendment clearly states, The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no Warrants shall issue, but upon probable cause, supported by Oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized. ... Or, the particular circumstances justify the search without a warrant first being issued” The fourth amendment applies to a search only if a person has a “legitimate expectation of privacy”. Courts use a two-part test to determine whether, at the time of the search, a defendant had a legitimate expectation of privacy in the place or things searched: did the person subjectively (actually) expect some degree of privacy? ... So legitimate expectation of privacy is null with regards to either computers.
