Because the R&D department oversees Abdul’s postion and has decided to eliminate it and his employment with the company due to “budget concerns”, even though members of other religions with less seniority are to remain untouched, Abdul has decided he’s had enough and will file a complaint with his company’s HR department urging them to pursue religious discrimination charges against the R&D department. ... Title VII of the Civil Rights Act of 1964 prohibits discrimination on the basis of religious beliefs. Although Abdul may have reason to claim race discrimination, he has heard that employees of Muslim faith from other countries and races are receiving similar treatment. ... Title VII lists the following explanation regarding religious discrimination:
· The term ``religion includes all aspects of religious observance and
practice, as well as belief, unless an employer demonstrates that he is
unable to reasonably accommodate to an employees or prospective
employees religious observance or practice without undue hardship on the
employer. ... Rahim will address is that his position was eliminated by those in the R&D department strictly because of his religious views and, to a lesser extent, because of the vehement hatred of all Muslims by many within the company due to the events of 9/11. ... However, because the state of Utah has it’s own discrimination laws, the charge must first be presented to the Utah Labor Commission. The Utah state laws regarding workplace discrimination filings and reconciliation require the following procedures be used:
(1) (a) Any person claiming to be aggrieved by a discriminatory or prohibited employment practice may, or that persons attorney or agent may, make, sign, and file with the division a request for agency action
(2) Any employer, labor organization, joint apprenticeship committee, or vocational school who has an employee or member who refuses or threatens to refuse to comply with this chapter may file with the division a request for agency action asking the division for assistance to obtain the employees or members compliance by conciliation or other remedial action.
