FACTS
Hawkins (P) agreed to let McGee(D) surgically remove scar tissue and perform a skin graft on his hand, fully believing Ds alleged guarantee of making the hand a "hundred percent good hand". ... (He had performed up to the standards of his occupation at that time and place - Hawkins did not appeal. But McGee freely entered into another agreement, beyond the duty of his profession. ... McGee settled for $1,400 before the new trial took place.
