However, the majority of concerns about the appropriateness of jury trial for these cases stem from two main issues - the complexity and length of such trials.These are discussed below, together with a consideration of better trial management and the issue of cost. (i) Complexity 2.10 It has been argued that the subject matter of fraud trials is uniquely complex and that it is unreasonable to expect the average person to understand the alleged actions of these defendants and hence reach an informed view of guilt or innocence.This argument takes the view that whilst it might be possible to state the issue of dishonesty in relatively simple terms, this can often only be properly assessed if the associated very complex and intricate circumstances are understood.
