The article by John Donahue, “The devil in devolution” can be summarized with several representations from the article of past and present responsibilities of states and the conflicts that they sometimes cause. Donahue first brings to the table the idea the metaphor of the “commons.” The “commons” refers to a study conducted by Garrett Hardin where “collective value is squandered in the name of a constricted definition of gain.” Basically, what this represents is that people as a whole will work towards a goal that is beneficial to their individual gain, no matter what the other outcome to society may be. After explaining this metaphor, Donahue points out several representations of the states enacting their individual powers. One of the historical representations he uses is human slavery and the fact that the national government was needed on this issue to define what was legal and illegal. Individual states were unable to handle the issue on their own because every state was different and traveling between states became very difficult because of the different stipulations. This can be compared to a more recent situation which is that of same-sex marriages and divorce laws being left up to individual states. There is a major problem in allowing each state develop its own laws in regards to these issues because you find people crossing state borders to achieve something that may not be recognized in their states.
