State agencies have primary responsibility for regulating the use of pesticides. The EPA New England Office maintains an oversight role for these cooperative agreements, but the primary authority for most compliance and enforcement actions regarding the use of pesticides rests with the states themselves. ... These products are regulated as pesticides under the Federal Insecticide, Fungicide and Rodenticide Act – or FIFRA – the FIFRA will prevent or destroy pests, such as algae, viruses and bacteria. Under FIFRA, regulated pesticides must be registered with EPA before they are sold or distributed, and the claims made on the products labels about the product must be accurate just like anything else that is sold in the stores.
