“The New York State Bar Association believes that the following issues should be of concern with the death penalty: The potential for executing someone innocent; excluding anyone under the age of eight teen years old from eligibility; creating a “true life sentence” without parole as an alternative to the death penalty; barring anyone classified as mentally disabled from a death sentence; safeguards that will prove capitol sentencing form falling disproportionately on blacks and other minorities; and increasing from twenty to thirty five percent the number of preemptory challenges available in cases where the death penalty is sought.
