Barron v The Mayor and City Council of Baltimore ISSUE: Does the Fifth Amendment deny the states as well as the national government the right to take private property for public use without justly compensating the property's owner? FACTS: John Barron was the co-owner of the Craig & Barron Company which owned an extensive and highly productive wharf in the eastern area of Baltimore. Much of the company’s quickly-found success was due to the fact that the wharf held the deepest water in the harbor. As the city of Baltimore continued to expand and develop its streets, large quantities of sand began to accumulate in the harbor.
