In addition, the procedures where by the Registrar takes is as follows: The application for the trademark shall state that the trademark is used for trading purposes by the person applying for it, or with his consent, relating to the services, or that he has a genuine purpose of using it. The trademark shall not be devoid of any unique characters. The trademark shall not consist of signs or indication which may serve in trade, to designate the kind, quality, quantity, the reason it is meant for, value, the time and place of production of goods or rendering of services, or other characteristics of the goods and services and trademarks which consist exclusively of signs and indications which have become customary in the current language, or in the genuine and established practices of the trade. ... At this point of time Augusta would be deemed a trademark under the Trade Marks Act and is protected by the courts of law. b) If Augustine is successful in his application of the trademark, he will be granted exclusive use of his brand name ‘Augusta’ for 10 years from the day he registered his trademark. ... The right conferred by a registered trademark extends throughout Singapore.
