The purpose of this paper is to examine whether the first amendment; “that congress will pass no law which abridges a persons freedom of speech…”; has been violated in American history. ... This act basically stated that no one had free speech during time of war. ... On the other hand Schenck said, “His actions were a form of free speech and claimed the Espionage Act abridged the rights of free speech”. ... The issue became, does the Espionage Act violate the First Amendment in respect to Schenck’s freedom of speech? The Supreme Court’s decision was that there is the existence of a “clear and present danger”, a situation in which free speech could bring no harm.
