Federalism, Are We There Yet?
...y and maybe if we had harsher sentences we just might have. A Federal run system would allow practicing attorneys to cross state lines, since the state wouldn’t be trying the case. Also the bar exam would be broken down into one test only. This would save money for the states and who knows who else would benefit financially? Another positive purpose in changing to a Federal system would be the elimination of plea bargaining. Currently our plea bargain program is run by state agencies and it relies on individual’s who turn states evidence to help or completely eliminate their sentence. This is enough to consider the change alone. The other change which would be affected by a Federal run system is eliminating any sentences which have up to this point been imposed by a jury, when the person is found guilty. The fact that I wouldn’t have to make a decision in sentencing someone to death is a very important issue to me, and im sure there are others who feel the same anxiety at the thought. There is always disadvantages when discussing such a big change as Federalism. We could have difficulties getting congress to agree to this method, this could Especially, when we have a negative track record when it comes to our Federal system already in check. When ever our Federal government is involved people get angry, so angry at time they chose to not support the cause and actually take a defiant role. This is due in part to our government going over and beyond what is necessary, they have a reputation of the big bully attitude when taking over an situation. Take for instance the whole Patriot Act, this gives people the feelings of jumping into some situation head first, without thinking of the entire consequences. It’s what we are use to when seeing our government go through the changes, so abruptly. It is deeply concerning to me how much power the government has and what they can do with it. This is an important enough topic to consider giving up so much to the federal government of, how much power does the government have to gather intelligence information for there purpose. Our history speaks for itself in terms of where we are today. The system of checks and balances was created to keep this system in check. My feeling about this system is it worked at one point but today it seems as though everyone in the political arena has their own agenda. It is a system that is spinning out of control and it’...
