Identification and Context of the Issue
In the 1990’s, few single issues have raised as much controversy as has drug testing. Many students across the country are subject to a drug-testing policy. School drug-testing policies range from testing only those students who participate in extracurricular activities to testing all students, whereby school districts have the authority to choose whether or not to institute a testing program (Magnarelli, 2002).
The issue of testing students for drugs has made its way to court on more than one occasion. The Supreme Court ruled on June 26, 1995, that a program of random urinalysis testing for middle and high school athletes was not a violation of the Fourth Amendment’s prohibition of “unreasonable searches and seizures.
